Below, under “General Terms and Conditions of JAY’S BAVARIAN TOURS“, you can read the official Terms and Conditions for usage of my website and company. These are required and are simply a good idea, as most businesses know. However, even though I have tried to keep my T+Cs as short and understandable as possible, I know many people do not want to read through an entire page of legalese, when there are so many exciting tours to consider. So I am going to list a few bullet points to answer some of the obvious questions. You can read more FAQs here, and other questions can be answered by reading the entire Terms and Conditions listed below, or by sending me a message.

  • Included in every tour price are door to door service, my tour guiding and driving services for the day.
  • Not included are all ticket and entrance fees, any various travel necessities such as busses, cable cars, horse-drawn carriages, and similar.
  • A 20% down payment is due at the time of booking. You will receive a booking confirmation with a secure link to a payment page.
  • The balance is due three (3) weeks before the tour date. The balance can be paid anytime prior to three (3) weeks before the tour date.
  • Payment is possible with American Express, MasterCard or Visa, PayPal, or bank transfer.
  • Traffic and unforeseen events may influence the itinerary.

General Terms and Conditions of JAY’S BAVARIAN TOURS

In these General Terms and Conditions of Jay’s Bavarian Tours (“T+C”), the following terms are defined as set forth below:

1. General

1.1. These terms and conditions, together with any other written information brought to your attention before we confirm your booking, shall form the basis of your contract with Jay’s Bavarian Tours.

1.2. Jay’s Bavarian Tours is a company registered in Germany, with a registered office at Clemensstrasse 64 80796 Munich, Germany (“I”, ‘us’, or ‘we’), in respect of the relevant tour guide booking (together referred to in these terms and conditions as ‘bookings’ or ‘tours’) to be provided by us. Our website is located at www.jaysbavariantours.com and is referred to as “site”.

1.3. We endeavor to ensure that the information and prices on our website and any other media are accurate; however occasionally changes and errors occur and we reserve the right to correct prices and other details in such circumstances.

1.4. All tour guide bookings are sold subject to availability and suitability and are not confirmed until you receive your booking confirmation and invoice from us.’

2. Applicability of these Terms

2.1. All activities performed by Jay’s Bavarian Tours will be solely on the basis of these Terms. Jay’s Bavarian Tours provides this site to you subject to these Terms. By using the site, you agree to comply with and be bound by the Terms. Other general terms and conditions are not applicable. If you do not agree to these Terms, do not use the site.

2.2. If any provision of these Terms, or the agreement (or parts thereof) as a result of using the site, proves to be void for whatever reason, this does not affect the validity of the other provisions.

3. Offer, acceptance, unforeseen changes and pricing

3.1. An agreement is created upon your acceptance of Jay’s Bavarian Tours offer. Acceptance can be arranged either directly between yourself and Jay’s Bavarian Tours or through the services of this Website. After the creation of the agreement, you receive a confirmation from us as soon as possible, electronically in the form of an email with the attached Invoice/Tour agreement. By confirming the confirmation of the invoice or agreement or by using the services of Jay’s Bavarian Tours, you are committed to this agreement.

3.2. Jay’s Bavarian Tours reserves the right to change planned itinerary agreements in the case of unforeseen obstacles and hindrances including, but not limited to, weather, construction, changing of opening times, and other events not in the control of Jay’s Bavarian Tours that may impede the fulfillment of any agreed upon itinerary. Jay’s Bavarian Tours agrees to complete the tour with an alternative itinerary that will be arranged spontaneously between the traveler(s) and Jay’s Bavarian Tours.

3.3. Pricing and invoicing will take place at the rates and prices as agreed upon in the agreement. Payment will be made in euros. Pricing is set by Jay’s Bavarian Tours directly. Every tour page will have a detailed pricing list.

4. Cancellations

4.1. Cancellations made 21 days or more prior to the booked tour date receive an 80% refund.

4.2. Cancellations made between 11 days and 20 days prior to the booked tour date will receive a 50% refund

4.3. Cancellations made 10 days or less prior to the booked tour date, as well as travelers that do not show up for the arranged tour, will not be refunded.

4a. Cancellations by Jay’s Bavarian Tours:

4a.1. If a booked tour can’t be done by Jay’s Bavarian Tours due to serious circumstances, Jay’s Bavarian Tours will make every effort to find a suitable substitute or to offer a different date to the client. If this doesn’t work or the client doesn’t agree, the full deposit will be refunded to the client.

4a.2. Jay’s Bavarian Tours takes no responsibility for any expenses or consequential losses as a result of the canceled booking such as non-refundable flight or other travel costs, loss of enjoyment, etc. The liability of MDG for canceled services is limited to the sumt paid by the traveler.

5. Delay of Client

The client shall inform Jay’s Bavarian Tours immediately about any delays, using the mobile phone number receives with the booking confirmation. This can be done over text message, WhatsApp, or a phone call. If the booked service has to be shortened due to the delay of the client, the fee agreed upon in the confirmation will be due nonetheless. In case the client will be late, there is no entitlement for a prolongation of the tour or any reduction of the fee. Jay’s Bavarian Tours will be waiting one hour for the client to show up. In case of a delay of more than 1 hour, Jay’s Bavarian Tours has the right to rescind the contract with full payment.

This rule does not apply to aircraft delays on layover tours or airport pick-up. Here Jay’s Bavarian Tours will track the arrival time of the aircraft over the Internet and, if possible, start the tour accordingly later. Jay’s Bavarian Tours will not be obligated to adjust the ending time of the tour. If the tour is no longer possible because of the delay, the full tour price must be paid, and if the tour has to be shortened, the full tour price must be paid.

6. What is included and what is not included in the total tour price.

!! Please note!! This is a list based on a basic tour price. This price is including no tickets or entrance fees. We may opt to include tickets and entry fees. This will always be possible and will always be clearly stated in the booking confirmation.

Included:

6.1. All vehicle and parking fees.

6.2.All German Taxes

6.3. Door-to-door pick up and drop off from a Munich city center location, such as a hotel or an Airbnb, and so on.

6.4. Private tour guiding services and driving services.

Not included:

6.5. All ticket and entrance fees, including, but not limited to, boats, busses, castles, museums, cable cars and similar.

6.6. Any extra activities not specifically stated as being part of the final tour price.

6.7. Food, drinks, souvenirs

7. Client Duty.

7.1. It’s the client’s duty, to cooperate in the fulfillment of the contract and to avoid damages and perturbations. He shall inform Jay’s Bavarian Tours in time about any particularities as impaired mobility, standing disabilities or similar disorders. In case there is no prior notification or just right before the start of the tour, Jay’s Bavarian Tours does not assume liability for any possible service limitations.

7.2. Any complaints have to be brought to the Jay’s Bavarian Tours notice immediately. Any claim of charges due to no or incomplete service delivery be made in writing to Jay’s Bavarian Tours in written form not later than a month after the fulfillment of service. Any claims expire by limitation 6 months after the fulfillment of the service agreed upon.

7.3. All guests must have a valid passport on them during the tour!

7.4. Children who need a child seat must contact Jay’s Bavarian Tours at booking to ensure that a seat will be provided.

8. Deposit and Payment.

8.1. A 20% deposit is required when the booking is confirmed. You will receive an email from me with an invoice and a link to a secure payment page. Payment can be made with American Express, Visa, MasterCard, via bank transfer or PayPal. You will receive a “Payment received” confirmation with the balance due as soon as the payment has reached Jay’s Bavarian Tours. This deposit is non-refundable.

8.2. The balance due will be listed on your invoice, and is due 3 (three) weeks before the tour date listed on the booking confirmation/tour invoice.

9. Warranties for using the Site

9.1. By using the Site, you represent and warrant that you have the right, authority, and capacity to enter into agreements and to abide by all of the terms and conditions herein. You further represent and warrant that all registration information you submit is truthful and accurate and that you agree to maintain the accuracy of such information. You are solely responsible for all content published or displayed through using the Site and for your interactions with other users of the Site. You must be eighteen (18) or over to use the Site.

10. Intellectual and industrial property rights

10.1. The Site and all text, images, marks, logo, trademarks and other content contained herein, including the Jay’s Bavarian Tours logo are the property of Jay’s Bavarian Tours. All photography is property of Jay’s Bavarian Tours and was taken and edited by us.

11. Outside operators:

11.1. Jay’s Bavarian Tours uses many outside, or third party, operators, in order to reserve, purchase or otherwise acquire tickets and confirmations for many events and tourist sites. Jay’s Bavarian Tours assumes no responsibility for incorrect information collected from any of the third party sites, and for any delay, changes in schedule, ticket availability or changes in opening times or Ticket/reservation prices. All fees and tickets that are included in the paid final tour invoice are not subject to change,

12. General exclusions and limitation of liability

12.1. Use of the Site shall be at your sole risk. To the fullest extent permitted by law in each applicable jurisdiction, Jay’s Bavarian Tours disclaims all warranties in connection with the Site and your use thereof. Jay’s Bavarian Tours assumes no liability or responsibility for: errors, mistakes, or inaccuracies in the content of the site, although we do ensure to check the accuracy of all content before we publish it on the site; personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the site and tours booked through the site; any bugs, viruses, trojan horses, or the like which may be transmitted to or through the Site by any third party; and/or any product or service advertised or offered by a third party through the Site.

12.2. Nor is Jay’s Bavarian Tours liable if and insofar you have been able to claim your loss under an insurance policy, such as a travel and/or holiday insurance policy. All liability on the part of Jay’s Bavarian Tours will in any case be limited to the amount being paid to Jay’s Bavarian Tours or invoiced by Jay’s Bavarian Tours.

12.3. In these matters as mentioned in articles 7.1., and 7.2. above, an exception will be made in the event of malicious intent or equivalent gross negligence on the part of Jay’s Bavarian Tours.

13. Indemnity

13.1. You agree to defend, indemnify and hold harmless Jay’s Bavarian Tours from and against any and all claims, also by third parties, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: your use of, and access to, the Site; your use of us as your tour guide; your violation of these Terms; and/or personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Site and/or use of us as your tour guide unless such claims result from gross negligence or intentional misconduct on the part of Jay’s Bavarian Tours.

14. Disputes and applicable law

14.1. Disputes that cannot be solved amicably by the parties involved will be subject to the laws of Germany. Disputes will be settled by the competent and appropriate court in Germany or through arbitration if this has been agreed upon with the parties involved.

15. Force Majeure.

15.1. The Party affected by Force Majeure shall not assume any liability under this Agreement. However, subject to the Party affected by Force Majeure having taken its reasonable and practicable efforts to perform this Agreement, the Party claiming for exemption of the liabilities may only be exempted from performing such liability as within limitation of the part performance delayed or prevented by Force Majeure. Once causes for such exemption of liabilities are rectified and remedied, both parties agree to resume performance of this Agreement with their best efforts.

15.2. In the case of a Force Majeure, Jay’s Bavarian Tours will offer a full refund (minus any unretrievable expenses, should there be any), credit for a future tour, or a rescheduling of the affected tour.
